An affidavit is a statement you swear is true. The notary does not investigate it, approve it or grant you anything. He confirms that you appeared before him and signed it, and he stamps it. That is the whole of what happens, and understanding it explains everything else on this page.

Because it is your own declaration, it binds you and nobody else. That is why a bank will often act on it and a passport counter will not. The counter is not being difficult; it is being asked to change a national record on the strength of a page you wrote about yourself. A reason is worth adding where you have one, and marriage, divorce, numerology, religion or simple preference are all acceptable. Nobody in Tripura or Delhi is going to judge the reason. What they check is that the names and the address agree with the documents behind them.

Short, and deliberately so. An affidavit that runs to two pages of recitals is not stronger than this one; it simply gives more places for a spelling to go wrong. What makes it work is that the names, the parent's name and the address match your documents letter for letter.

Sign twice. Once as deponent under the numbered paragraphs, and once as deponent under the verification clause. An affidavit signed only at the bottom comes back.

Different affidavits for different cases

A marriage affidavit drafted like a minor's affidavit will be returned, and so will a correction affidavit drafted like a change of name. The five cases and what each adds:

The last row is the one people get wrong most often. If your name was never changed and a clerk simply wrote it badly, you are not declaring a change. You are declaring that the record is wrong. Saying it the other way round tells every office that your old documents were correct, which is the opposite of what you want.

Stamp paper and notaries in Tripura

You will find a great many stamp values quoted online for this, Rs 10, Rs 20, Rs 100. Every one of those is another state's figure, quoted from another state's form. Stamp duty is a state matter, so the honest answer for Tripura is that your stationer or the notary's clerk will tell you the value used locally, and that it is small. Anybody charging you a large sum for the paper itself is charging you for their time, not for the stamp.

What the newspaper will ask about your affidavit

When you book the two notices, the paper's advertisement desk asks for the affidavit itself, and there are three things about it that catch people out.

That last row needs a caveat, because a correction notice covering a parent and a child together is a real and useful thing. Editorial policy on classified notices is the newspaper's own, not a Gazette rule, so where your case covers more than one person, confirm the format with the paper before booking rather than assuming either way. The deed route for Central Government staff follows the Ministry of Home Affairs Office Memorandum No. 190016/1/87-Estt.(A) dated 12 March 1987, with a service book entry afterwards. The pattern is simple once you see it. Offices that hold their own record and can see you will often act on your declaration. Offices that issue a national document, or that verify you for somebody else, want the change published. That is not an objection to your honesty; it is the difference between a private statement and a public record.

From your affidavit to the Central Gazette

Your affidavit is not replaced by the Gazette. It goes into the Gazette file as the first of five papers, and its wording sets the wording of everything else. That is the practical reason to have it drafted properly rather than typed at a shop: a difference of one letter between the affidavit and the proforma is enough for the file to come back, and the Government fee is not refundable.

The other four papers, and who prepares them

After the affidavit come the two newspaper notices, then the CD certificate declaring that the soft copy matches the hard copy and is in MS Word format, then the request letter to the Controller, Publication Department, Civil Line, Delhi 110054, then the proforma in two copies, computer typed and signed in your existing old name with two witnesses. An affidavit is genuinely cheap. Treat any quote that makes it sound expensive as a quote for somebody's service, and ask which part is the stamp and which part is the fee.
