Reverting to Maiden Name After Divorce in Tripura

Going back to your maiden name is the most common name change after divorce, and the one with a hidden advantage: the name already exists on your school certificate, your old voter ID, maybe an old passport. The job is not to invent a name but to restore one, and to spell it so those old records match the new ones. This page gives you the decree's role, the exact "resuming my name" affidavit, which offices in Tripura accept the decree alone, which want the Gazette, and how to avoid the spelling trap that turns a restoration into a new mismatch.

Quick answer

To revert to your maiden name after divorce in Tripura, take a certified copy of the decree, find your maiden name's spelling on an old record such as your Class 10 certificate, sign an affidavit stating that you are resuming your name before marriage, publish in a Bengali and an English daily, and file the Central Gazette with the decree attached. Some Aadhaar centres accept the decree and affidavit alone; PAN, banks and the passport office want the Gazette.

The name change after divorce guide covers all three choices. This page is only the first one, reverting, because it has two things the others do not: an existing name with existing records, and a specific word in the affidavit that the Gazette office and the passport office expect to see.

Reverting to your maiden name at a glance

Reason document

Old name
Your married name as on Aadhaar today
Restored name
Your maiden name, spelt as on your oldest surviving record
Affidavit word
"Resuming my name before marriage", with the decree quoted
Relationship line

Accept decree alone
Some Aadhaar Seva Kendras, at discretion; the passport office for the spouse field only
Want the Gazette

Gazette fee
Commonly Rs 1,100, on BharatKosh, revised each financial year
Time
3 to 7 weeks to publication, then the updates

Key takeaways

  • Reverting is a name change, not an undo. The married name on Aadhaar is your legal name until the Gazette prints the maiden one again.
  • Spell the restored name as your old records spell it, not as you would spell it today. That is what links your Class 10 certificate to your new Aadhaar.
  • "Resuming", not "adopting". The affidavit says you are resuming your name before marriage, with the decree's date, case number and court.
  • The decree alone gets you partway at some offices. The Gazette gets you all the way at every office. Do the Gazette once.
  • The marriage certificate, if you still have it, is useful: it shows the chain from maiden to married name.
  • Your children's surname is untouched by your reversion; that is a separate application, on child surname change after divorce.

The spelling trap: which maiden name you restore after divorce

Reverting to maiden name after divorce in Tripura, old certificate and the Gazette that restores it
The old certificate sets the spelling; the Gazette restores it.

Here is the trap. You were Rina Deb Barma on your Madhyamik certificate in 2012. You married and became Rina Chakraborty. Now you want to go back, and today you would write your name Rina Debbarma. If the affidavit and Gazette say Debbarma, your restored Aadhaar will say Debbarma and your Class 10 certificate will still say Deb Barma. You have not gone back to your old name; you have created a third one.

So before the affidavit is typed, pull the oldest surviving record in your maiden name: the Class 10 certificate, an old voter ID, an old passport, the marriage certificate's bride column. Restore the name exactly as it appears there. If the old records disagree among themselves, choose the one on the Class 10 certificate, because TBSE and universities are the hardest to correct later, and note the other spelling in the "one and the same person" line.

What we do here. We ask for the old record first, before the decree. The spelling on it becomes the restored name on the affidavit, both newspapers and the proforma, letter for letter, and we check all four against it before anything prints.

The divorce decree when you revert to your maiden name

The decree is quoted in the affidavit and attached to the Gazette file as a self-attested copy of the certified copy. It proves that the marriage which gave you the married name has ended, which is why the Gazette office accepts "resuming my name before marriage" as the reason without a question. Get the certified copy from the copying section of the court that passed the decree, on an application with the case number. Your married name on the decree should match your Aadhaar; if the court spelt it differently, carry the marriage certificate as the bridge.

Family Court, Agartala

Most divorces from West Tripura and the districts within its jurisdiction. Certified copies on application to the copying section.

District Judge's court

For districts where the Family Court does not sit. The same copying application.

Mutual consent decrees

The decree under Section 13B of the Hindu Marriage Act or Section 28 of the Special Marriage Act works the same way. It is the dissolution that matters, not the ground.

The "resuming my name" affidavit for reverting to a maiden name in Tripura

AFFIDAVIT

I, [MARRIED NAME, as on Aadhaar], daughter of [FATHER'S NAME], aged about [age] years, resident of [ADDRESS, TOWN, DISTRICT, TRIPURA, PIN], do hereby solemnly affirm and declare as follows:

1. That I was married to [FORMER HUSBAND'S NAME] on [DATE], and after the marriage I used the name [MARRIED NAME].
2. That the said marriage was dissolved by a decree of divorce dated [DATE] passed in [CASE NUMBER] by the [COURT], a certified copy of which is annexed.
3. That before my marriage I was known as [MAIDEN NAME, as on old record], and after the dissolution of my marriage I have resumed my name before marriage and shall hereafter be known as [MAIDEN NAME] for all purposes.
4. That [MARRIED NAME] and [MAIDEN NAME] are the names of one and the same person, that is, myself.
5. That this affidavit is made to declare my change of name for record in the Gazette of India and in all my documents, and the above statements are true and correct to the best of my knowledge and belief.

DEPONENT

VERIFICATION: Verified at [town], Tripura, on this [date], that the contents of the above affidavit are true and correct, and nothing material has been concealed.

DEPONENT

An illustrative Tripura example (not a real person):

I, Rina Chakraborty, daughter of Subhas Deb Barma, aged about 32 years, resident of Rampur Road, Udaipur, Gomati, Tripura 799120... 1. That I was married to Arup Chakraborty on 12 February 2018, and after the marriage I used the name Rina Chakraborty. 2. That the said marriage was dissolved by a decree of divorce dated [date] passed in [case number] by the Family Court, Agartala... 3. That before my marriage I was known as Rina Deb Barma, and after the dissolution of my marriage I have resumed my name before marriage and shall hereafter be known as Rina Deb Barma for all purposes...

Notice "Deb Barma" with a space in the restored name, because that is how her 2012 certificate spells it, even though her father's family may now write Debbarma. You sign in the married name, before a notary in your district, with a witness. The stamp paper and notary points are the same as on the affidavit after marriage page.

What happens to your old records when you revert to your maiden name

They come back into use. Your Class 10 and Class 12 certificates, your degree, an old voter ID or passport in the maiden name were all "wrong" while you carried the married name and needed a bridge affidavit at every KYC. Once the Gazette restores the maiden name and Aadhaar follows, those records match your ID again without any correction at TBSE or the university. That is the one thing a reversion gives you that a new name does not.

Old records after reverting to a maiden name
RecordAfter reversion
TBSE, university certificates in the maiden nameMatch your new Aadhaar again; no correction needed if the spelling was restored exactly
Certificates issued in the married name during the marriageStay in the married name; the "one and the same person" line in your affidavit bridges them
Old passport in the maiden name, expiredUseful as spelling proof; the new passport is a re-issue of your current one
ST, SC or caste certificateCommunity unchanged; the name is corrected to the restored one through e-District Tripura if it was ever changed to the married name
Property bought in the married nameStays valid; the Gazette links the names for any future sale or mutation

Mistakes women in Tripura make when reverting to a maiden name

Spelling and wording

  • Restoring the name in today's spelling instead of the old record's
  • Writing "adopted" or "changed to" instead of "resumed my name before marriage"
  • Leaving the relationship line as "wife of"
  • Signing in the maiden name before the Gazette exists

Paper and process

  • A photocopy of the lawyer's decree instead of a certified copy
  • Trying each office with the decree alone, then filing the Gazette a year later
  • Using a marriage-format affidavit with the decree stapled on
  • Forgetting the spouse-name removal at the same passport re-issue

Central Gazette for resuming your name before marriage

Resuming a maiden name feels like going back, but to an office it is a change of name like any other: the record says one thing today and you are asking it to say another. The affidavit for it is worded to say you are resuming the name you held before marriage, and the decree is attached. Where an office wants more than a declaration, the Central Gazette supplies it, being a notice published by the Government of India in Part IV of the Gazette of India.

When the Central Gazette is the answer

Situations that need a Central Gazette notification
Your situationWhy the Gazette is what works
The decree is silent on the nameVery common, and it is what offices question
A bank or employer has refused the affidavitWritten rules need a published notice
Your passport or service record is involvedThose follow rules rather than sympathy
You changed the name socially years agoPublishing regularises it without further explanation
You want the maiden name restored everywhere at onceOne notice, then one application per record

The papers that make up the file

The file is five papers long, and each one takes its wording from the one before it.

The papers in a Central Gazette name change file
StepPaperWhat it has to contain
1AffidavitNon-judicial stamp paper, notarised in person in Tripura, naming you, your father's or husband's name and your full address, declaring the change from the old name to the new one, and closing with a verification giving the place and date. For a marriage case it names the maiden name, the married name and the date of marriage.
2Two newspaper noticesThe same wording in one Bengali daily and one English daily circulating in Tripura, with the complete original page of each kept. A cutting is refused.
3CD certificateA separate signed page declaring that the CD and the hard copy carry the same matter, that you are responsible for any mismatch and for the quality of the CD, and that the CD is in MS Word format.
4Request letterAddressed to the Controller, Publication Department, Civil Line, Delhi 110054, saying the formalities are complete and the documents are enclosed.
5The notice, in two copiesThe notice itself, in the Department's wording, signed in your existing old name. Two witnesses sign it, each writing a full name and a complete address.

What the papers actually say

The wording is fixed, and that is a good thing: you are not drafting anything, only filling it in. This is the shape of it.

The proforma, the page the Gazette prints

No. ADVT IV /

Divorce and name change terms, explained

Words you will meet at a counter, in one place.

Gazette notification
A formal announcement printed in the official journal of the Government. For a name change it is the document Aadhaar, PAN, passport offices, banks and employers accept as proof that the change was made.
Central Gazette
The Gazette of India, published by the Department of Publication at Civil Lines, Delhi. It is accepted in every office in India, including every office in Tripura, and by foreign missions.
Part IV
The section of the Gazette of India that carries notices from private people rather than from the Government. A personal name change appears here and nowhere else.
Decree of divorce
The court order dissolving a marriage. Many decrees say nothing about the name afterwards, which is why offices ask for more.
Maiden name
The name a woman held before marriage. A marksheet or degree in a maiden name is normal and is explained by the marriage certificate rather than corrected.
Affidavit
A written statement you swear is true before a notary. For a name change it records your old name, your new name, your parent's or husband's name, your address and the reason.
Proforma
The typed page that becomes your Gazette notice. It is filed in two identical copies, signed in your existing old name, and witnessed by two people.
Guardian consent
The written agreement of both parents, or of a single parent with the prescribed annexure, required before a child's name is changed on any record.
Minor fee
The lower Government fee charged when a Gazette notice is filed for a person under eighteen, commonly Rs 1,700 against Rs 1,100 for an adult.
Newspaper notice
The same wording published in one Bengali daily and one English daily circulating in Tripura. The complete original page of each is kept, because a cutting is refused.
CD certificate
A signed page declaring that the soft copy and the hard copy of your notice carry the same matter, that you are responsible for any mismatch and for the quality of the CD, and that the file is in MS Word format.
Notary public
A person authorised by the Government to witness signatures and certify documents. Notarisation is done in person in Tripura and is the one step that cannot be completed online.

Reverting to a maiden name, the questions people search in Tripura

Can I go back to my maiden name with just the divorce decree?

At some Aadhaar centres, with an affidavit, yes. At PAN, banks and the passport office, no; they want the Gazette. Doing the Gazette once avoids the argument everywhere.

Why does the affidavit say "resuming" and not "changing"?

Because you are restoring a name that already exists on your records. The Gazette office and the passport office read "resuming my name before marriage" with the decree as a complete reason.

Which spelling of my maiden name do I use?

The one on your oldest surviving record, usually your Class 10 certificate, so that record matches your new Aadhaar without a correction.

Do I need to correct my school certificates?

No. If you restore the exact old spelling, they already match. That is the advantage of reverting.

Does the decree remove my husband's name from my passport?

Yes, at re-issue. Your own name change at the same re-issue uses the Gazette, newspapers and affidavit.

How long does it take?

About a week for the affidavit and newspapers, 30 to 45 days for the Gazette, then 3 to 8 weeks of updates from Aadhaar to passport.

Send the old record and the decree; the rest is typed for you

WhatsApp your Class 10 certificate or old ID, the decree and your Aadhaar. You get the affidavit with the restored spelling checked against the old record, both fee numbers separately, and one advisor for the whole file, before you pay anything.

Reverting to maiden name after divorce in Tripura, frequently asked questions

How do I revert to my maiden name after divorce in Tripura?+
Get a certified copy of the decree, find your maiden name's spelling on an old record, sign an affidavit stating you are resuming your name before marriage, publish in a Bengali and an English daily, file the Central Gazette with the decree attached, then update Aadhaar, PAN, bank and passport in order.
Is the decree enough to revert my name?+
Some Aadhaar centres accept it with an affidavit. PAN, banks and the passport office want the Gazette for your own name. The decree removes the spouse name from the passport.
What is the exact affidavit wording?+
Married name as on Aadhaar, "daughter of" your father, the marriage and the decree's date, case number and court, "before my marriage I was known as [maiden name] and I have resumed my name before marriage", the "one and the same person" line, and the verification. The full text is on this page.
Which spelling of my maiden name should I use?+
The spelling on your oldest surviving record, usually the Class 10 certificate. Restoring today's preferred spelling creates a third name that matches nothing.
Do I sign in my maiden name or my married name?+
Married name, on the affidavit, proforma, undertaking and request letter, because that is your legal name until the Gazette prints the maiden one.
Where do I get the certified copy of the decree in Tripura?+
From the copying section of the court that passed it, the Family Court at Agartala or your District Judge's court, on application with the case number.
Do I need the marriage certificate too?+
Not compulsory, but useful: it shows the chain from maiden to married name, which helps if the court spelt your married name differently from Aadhaar.
Will my school and university certificates need correction?+
No, if you restore the exact old spelling. They already carry the maiden name and will match your new Aadhaar.
Does reverting count against the Aadhaar name change limit?+
Yes. Aadhaar allows two name changes in a lifetime, and a reversion is one of them. With the Gazette, a later change beyond the limit is still possible.
How much does it cost?+
Court copying fee, affidavit Rs 100 to Rs 500, two newspapers Rs 800 to Rs 4,000, and the Central Gazette fee, commonly Rs 1,100 on BharatKosh, revised each financial year. Our charge is a separate line.
How long does it take?+
About a week for the affidavit and newspapers, 30 to 45 days for the Gazette, then 3 to 8 weeks of updates. Around three months to the passport re-issue.
Can I do this from Kailashahar or Belonia?+
Yes. The decree is from your court, the affidavit from your local notary, the Gazette through our Delhi office. Only the passport step is at PSK Agartala.
