If your decree from the Family Court, Agartala, or your District Court gives you custody but is silent on the name, the safe path is a short application to the same court for an order permitting the change, or a signed consent from the other parent. Both are cheaper than a Gazette that is later challenged.

If the other parent refuses consent to the child's surname change

Then no documentation desk can do it for you, and anyone who says otherwise is selling a file that will not hold. The route is a petition to the Family Court or the District Court, under the Guardians and Wards Act or within the custody proceedings, asking for permission to change the child's surname. The court decides on one test: the welfare of the child. Courts look at who the child lives with, how long, the child's schooling and identity, the other parent's involvement and, for an older child, what the child wants. A father who pays maintenance and sees the child regularly is usually heard; a father who has disappeared usually is not.

The one thing to say clearly. Giving a child the mother's surname, or a step-father's surname, does not make the step-father the father on any record. Parents who later apply for the child's passport with a changed surname and a step-father's name written as "father" are asked for adoption papers they do not have. Change the surname if you wish; the father's name on the birth certificate is a fact of registration, not a name you can edit.

School, TBSE and Aadhaar for the child after the surname change

School records

The school updates the admission register and ID on the Gazette PDF and the parent's application. A custodial parent's signature is enough; a school cannot insist on the other parent's. Do this before Class 10, because after that the name goes to TBSE.

TBSE

If the child is already registered for Madhyamik or HS, the correction goes through the school to the board under TBSE's own rules, with the Gazette. Get it done before the registration is finalised; correcting a printed marksheet is slower.

Aadhaar

At the Seva Kendra with the Gazette PDF, the parent's Aadhaar and the birth certificate. A child's Aadhaar also carries a guardian's details for children under five; update those too if the custodial parent changed.

The child's passport with one parent after divorce in Tripura

Passport Seva expects both parents' consent for a minor's passport. Where the other parent's consent cannot be obtained, the applying parent files a single-parent declaration, the annexure Passport Seva prescribes for that situation, stating custody and the circumstances, with the decree and custody order attached. With the Gazette, the passport is issued or re-issued in the child's new surname. Sequence. Gazette first, then Aadhaar for the child, then the passport. The passport officer reads the Gazette for the surname and the decree and order for the single-parent question. Carry the school ID in the new name as well.

A child's surname is the most delicate change in this whole field, because two parents' rights and a custody order sit behind it. What the Gazette does is narrow and useful: it publishes the change once it is properly made, so that schools, boards and passport offices are not left deciding a family matter for themselves. It is filed by the parent on the minor form, with the custody papers behind it.

Divorce and name change terms, explained

The vocabulary of a Tripura name change, explained plainly.

Decree of divorce
The court order dissolving a marriage. Many decrees say nothing about the name afterwards, which is why offices ask for more.
Maiden name
The name a woman held before marriage. A marksheet or degree in a maiden name is normal and is explained by the marriage certificate rather than corrected.
Affidavit
A written statement you swear is true before a notary. For a name change it records your old name, your new name, your parent's or husband's name, your address and the reason.
Proforma
The typed page that becomes your Gazette notice. It is filed in two identical copies, signed in your existing old name, and witnessed by two people.
Guardian consent
The written agreement of both parents, or of a single parent with the prescribed annexure, required before a child's name is changed on any record.
Minor fee
The lower Government fee charged when a Gazette notice is filed for a person under eighteen, commonly Rs 1,700 against Rs 1,100 for an adult.
Newspaper notice
The same wording published in one Bengali daily and one English daily circulating in Tripura. The complete original page of each is kept, because a cutting is refused.
CD certificate
A signed page declaring that the soft copy and the hard copy of your notice carry the same matter, that you are responsible for any mismatch and for the quality of the CD, and that the file is in MS Word format.
Notary public
A person authorised by the Government to witness signatures and certify documents. Notarisation is done in person in Tripura and is the one step that cannot be completed online.
Department of Publication
The office of the Government of India that publishes the Gazette, at Civil Lines behind the Delhi Vidhan Sabha Metro Station. It is the only office in the country that accepts a personal name change file.
Two witnesses
The Gazette notice carries two witnesses, each giving a signature, a full name and a complete address. Initials or a partial address are a common reason a file is returned.
